BGH lässt erste Partnerschaftsgesellschaft von Anwalt und Arzt eintragen

Der BGH hat den Weg freigemacht für die erste Eintragung einer Partnerschaftsgesellschaft von einem Anwalt und einer Ärztin (zugleich Apothekerin) in das Partnerschaftsregister. Sechs Jahre lang mussten die beiden Partner für die Eintragung ihres Zusammenschlusses kämpfen. Auf eine Vorlage des BGH hin hatte das BVerfG Anfang dieses Jahres das Sozietätsverbot aus § 59a Abs. 1 Satz 1 BRAO insoweit für nichtig erklärt, als es einer Verbindung von Anwälten mit Ärzten und Apothekern zur gemeinschaftlichen Berufsausübung im Rahmen einer PartG entgegensteht (BVerfG, AnwBl 2016, 261).
